These Terms and conditions apply to the entire contents of the M2CASH® website and Online Transaction Platform and to correspondence of whatever nature between ‘M2CASH’® and you ‘the Customer/User’. Please read these Terms and Conditions thoroughly before using the Online Transaction Platform. Proceeding to use the Online Transaction Platform indicates that you (the Customer / User) accept these Terms and Conditions to perform foreign exchange transactions, local transactions or any transaction using the Online Transaction Platform and thus forms a legally binding contract. If you do not accept these Terms and Conditions, you will not be at able to use the Online Transaction Platform.
Introduction
Admittance to the Online Transaction Platform is restricted only to M2CASH® registered customers.
By entering any part of the website or Online Transaction Platform or by initiating and opening an account and transacting you, the Customer, will be considered to have accepted these Terms and Conditions in full.
M2CASH® permits you, the Customer a limited license to only access the Online Transaction Platform in accordance with these Terms and Conditions.
M2CASH® may revise or modify these Terms and Conditions at any time at the discretion of M2CASH® and without notice to you, the Customer. You, the Customer must review these Terms and Conditions regularly to ensure familiarity with the contents and current Terms and Conditions. Your (The Customer’s) continued use of the Online Transaction Platform following any modification of these Terms and Conditions will constitute your (the Customer’s) acceptance of such modifications to these Terms and Conditions. These changes will be effective and binding upon you when they appear on the website. Certain provisions of these Terms and Conditions may be superseded by expressly designated legal notices or terms located on particular pages at the website.
Registration
Each account User’s registration is for that individual User only. M2CASH® does not permit the registered User (you) to share their username, password or PIN number with any other person nor with multiple users on a network. Each user must provide as required, full identification to M2CASH® to open the account or add any additional information or credit accounts to exiting M2CASH® accounts.
You, the registered User, agrees not to share their username, password or PIN number with any other person nor with multiple users on a network.
Upon opening an M2CASH® account, each user will be required to select a username and a password. The password must contain at least 8 characters and must contain both letters and numbers. Passwords are case sensitive.
Upon logging into your (the customer’s) M2CASH® account, the username and the corresponding password and PIN number will be requested. Once this has been verified access will be granted to you (the User) and M2CASH® will not be required to take any further action to verify that the person accessing your (the Customer’s) M2CASH® account is the correct Customer or that the person accessing the account is authorised to perform roles assigned by the administrator.
If you (the User) forget your login or your password, you must contact M2CASH®and upon satisfactory completion of verification procedures M2CASH® will issue you (the User) with a new login or password which will be delivered via email to your registered email address. Should you forget both login and password you will need to open a new account to protect against fraud.
Each User has a responsibility to exercise reasonable care to prevent unauthorised access to their account or computer that you, the Customer, User uses to access the Online Transaction Platform. The User must not leave their computer unattended while they are online to the M2CASH® Online Transaction Platform.
In order to protect the security of your M2CASH® account you, (the User) must:
Never give the username, password or PIN number to anyone else; and
you must not write the password down anywhere.
Change the password regularly.
Diligently watch out for fraudulent (or ‘phishing’) e-mails that claim to be from M2CASH® that ask for personal information or security details. Never send personal details, accounts, passwords or PIN numbers in an email. If you suspect a phishing attack, you must immediately contact M2CASH® or alternatively forward the suspect e-mail to M2CASH® .
You (the User) represents and warrants that you have implemented and plan to operate and maintain appropriate protection in relation to the security and control of computer viruses, or other similar harmful devices, and you (the User) will not transmit to in any way, whether directly or indirectly, or expose M2CASH® ’s website or Online Transaction Platform to any harmful material or device.
You (the User) represent and warrant that you will maintain a firewall on your (the User’s) computer to protect it from unauthorised access.
Online Transactions are subject to a minimum and maximum transaction value determined by M2CASH® , who reserves the right to request further information before accepting a transaction.
M2CASH reserves the absolute right to reject any transaction it regards in its absolute discretion as suspicious.
Service access
While M2CASH® endeavours to ensure that the website and Online Transaction Platform are normally available 24 hours a day 7 days a week (or such hours as displayed on the website), M2CASH® will not be liable if for any reason should the website or Online Transaction Platform be unavailable at any given time. M2CASH® agrees to use reasonable efforts to give advanced notice of any scheduled interruption.
Privacy Policy
This Privacy Policy applies anytime you (the User) interacts or conducts business with M2CASH® .
M2CASH® collects and retains information about their Customers and Users that we believe is necessary to help administer business between M2CASH® and you (the Customer and User, to keep our Customers abreast of improvements to our services and products and to provide the Customers with other relevant information.
M2CASH® collects two types of information:
Personal information such as names, addresses, email addresses, copies of photographic identification, incorporation documents etc.
Traffic pattern information and transactional information on the Transaction Platform.
Personal information is collected to meet both internal and external compliance requirements, and to enable M2CASH® to open an account for you (the Customer) and to be in a position to proceed business. Traffic pattern information is used to monitor pages accessed or visited and enables M2CASH® to better meet the requirements and needs of our Customers. Transactional information reflects the business our Customer enters into with M2CASH® and provides a historical record of business activity which is necessary as a means of monitoring and mitigating money laundering and terrorist financing and also enabling M2CASH® to keep abreast with our Customer’s money transfer needs.
Customer and User information may be shared between M2CASH® ’s associated companies, service providers, affiliates and our agents in connection for the provision of money transfer and foreign exchange services. However M2CASH® requires all its associated companies, service providers, affiliates and agents to adhere to the criteria with respect to the security, collection, use and sharing of personal information and to comply with applicable law. M2CASH® is committed to respecting and protecting your privacy.
M2CASH® will never email to you asking you for your personal information. If you receive such an email do not respond.
M2CASH® does not sell, rent, lease, publish or freely give away personal or transactional information. The Customer’s and User’s personal information is treated strictly in accordance with the governing law. However, M2CASH® may use your contact information to inform you about our services. If you do not wish to receive this information you may inform us by emailing your preference together with your full name and contact details to us via our “contact us” web page or info@m2cash.com. Please allow 10 days for your preference to be processed.
Suspected fraud in your money transfer will result in M2CASH® passing on your money transfer information to the relevant national, state and/or local law enforcement in your country.
M2CASH® may if required by law and in compliance with the applicable law, pass on your personal information to the relevant governing body, government investigator or court.
M2CASH® is not responsible for the security, content or information engaged by other websites that are linked to or from our website. These sites are regulated by their own privacy policies and you should be aware of their privacy policies before relinquishing to them any of your personal information.
It is very important to M2CASH® to maintain your trust in us and we are continually monitoring and reviewing our Privacy Policy to protect your privacy. Our website will always contain our current Privacy Policy.

Risks & Cancellation Policy
You (the User) agrees to use the Online Transaction Platform at your (the User’s) own risk.
M2CASH® recommends that the Customer seeks prior independent financial and/or legal advice and consider carefully whether entering into any specific exchange transactions is appropriate in terms of the Customer’s experience, financial objectives, needs and circumstances.
Upon you (the User) selecting the “Accept” button on making a transfer transaction, a legally binding contract is formed between you (the Customer) and M2CASH® .
Legitimate refunds will in most cases be returned to the sender’s account immediately or within 72 hours (less any fees and charges).
Intellectual Property
It is permissible for our Customers to download and print information from the M2CASH® Online Transaction Platform for the Customer’s own use on the following basis:
No graphics on the Online Transaction Platform are used independently from the corresponding text.
No documents or related graphics on the Online Transaction Platform are altered in any way.
M2CASH®’s copyright and trade mark symbols appear in all copies.
There is no breach of M2CASH’s intellectual property in the use of the downloaded material.
The names, images and logos identifying M2CASH® and our services are proprietary marks of M2CASH®. The trademarks, names and logos on the M2CASH® website are the property of M2CASH® and may not be used without express written permission from m2cash®. You (the User) acknowledges and agrees that the content including without limitation the text, graphics, photographs or other material presented on the website and Online Transaction Platform is protected by copyright, trademark, patents and other proprietary rights and laws.
You (the User) may only use the contents as authorized by M2CASH®. Any use of extracts from the Online Transaction Platform and website other than in accordance with the aforementioned for any purpose is prohibited.
An infringement of these Terms and Conditions will result in immediate termination of your (the User’s) account and on request from M2CASH® must immediately destroy any downloaded or printed information extracted from the Online Transaction Platform or website.
Except for the afore mentioned no part of the Online Transaction Platform or website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without M2CASH®’s prior written permission.
Derivative use of the website or Online Transaction Platform is prohibited, including any use of data mining, robots or similar data gathering, reverse engineering and extraction tools with the intent of harming the website or Online Transaction Platform.
Any unauthorised use will terminate your (the User’s) account and association with M2CASH® . Your (the User’s) right to use the services of M2CASH® is conditional on your (the User’s) continued compliance with these Terms and Conditions in conjunction with the any rights not expressly granted in these Terms and Conditions are reserved.
LINKS FROM OTHER WEBSITES
If you (the User) wishes to link to the M2CASH® website, you can only do so with the prior written permission from M2CASH®, on the understanding that you link to, but does not replicate, the home page of the website, and subject to the following conditions and other conditions required by M2CASH®:
Do not remove, distort or otherwise alter the size or appearance of the M2CASH® logos.
Do not create a frame or any other browser or border environment around the website.
Do not in any way imply that M2CASH® is endorsing any products or services other than its own.
Do not misrepresent your (the Customer) relationship with M2CASH® nor present any other false information about M2CASH®.
Do not otherwise use any M2CASH® trade marks displayed on the website without express written permission from M2CASH®.
Do not link from a website that is not owned by you (the Customer).
Your (the Customer’s) website must not contain content that is distasteful, objectionable, offensive or controversial; infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all pertinent laws and regulations.
M2CASH® expressly reserves the right to revoke any right granted to you to link to our M2CASH® website should there be any breach of these Terms and Condition by you (the Customer) M2CASH® reserves the right to take any action it considers appropriate.
You (the Customer) will fully indemnify M2CASH® for any loss or damage suffered by M2CASH® or any of its service providers for breach of the above provisions.
Our M2CASH® website contains links to other websites which are not under our control. These links are provided for your (the User’s) convenience and M2CASH® is not responsible for, or endorses the contents, security or transmission of any website to which such a link is provided.

Neither M2CASH® nor any of the parties listed above shall be held liable for any kind of loss or damage suffered by Customers who were availing of the website or the Online Transaction Platform for non-business purposes.
Nothing in these Terms will exclude or limit M2CASH® 's liability for:
Death or personal injury caused by negligence, or
Fraud; or
Misrepresentation as to a fundamental matter; or
Any liability which cannot be excluded or limited under applicable law.
If the User’s utilization of material on the website or Online Transaction Platform results in the need for servicing, repair or correction of equipment, software or data, the Customer assumes all costs thereof.
M2CASH® is at liberty to assume that all transactions made using the User’s username, password and PIN number are authorised by the Customer. M2CASH® will not be liable in any way for any direct, indirect or consequential loss suffered by the Customer as a result of;
Any Transaction conducted using the User’s username, password and PIN number; or
Any suspension, withdrawal or termination of the User’s access to M2CASH® ’s Online Transaction Platform; or
Interruptions to the M2CASH® ’s Online Transaction Platform.
You (the Customer) indemnifies and holds M2CASH® harmless against any and all loss suffered by M2CASH®, which may result from the User’s misuse of M2CASH® ’s website or Online Transaction Platform or violation of these Terms and Conditions.
Access to the Website or Online Transaction Platform may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond M2CASH® 's control and M2CASH® will incur no liability to the Customer.
Market Information
M2CASH® make available market information services generated internally containing, but not limited to financial market data, rates, news, charts or data. Market information provided on this website or in email or SMS format is not intended as advice.
M2CASH® does not guarantee the accuracy, timelessness, completeness or correct sequencing of the market information. M2CASH® reserves the right to cease offering market information at any time without notice.
Cancellation of Client Access
M2CASH® may suspend or withdraw the User’s access to the M2CASH® Online Transaction Platform at any time without prior notice if:
The User has breached these Terms and Conditions or has acted fraudulently.
M2CASH® learns of the User’s death, bankruptcy or lack of legal capacity; or that the User has committed an act of bankruptcy or that a bankruptcy petition has been presented against them; or if the Customer is a company, that a liquidator or receiver has been appointed in respect of the Customer’s assets.
M2CASH® otherwise deems such suspension or withdrawal necessary or appropriate, in its sole discretion.
The Customer may cancel the User’s access to the M2CASH® Transaction Account at any time by giving M2CASH® written notice. The Customer will remain responsible for any transactions made on the Customer account through the Online Transaction Platform up until access to the Customer account is actually disabled.
Transactions in respect of which the User has given M2CASH® instructions and which are to be made after the User’s access to the M2CASH® Online Transaction Platform is terminated or suspended will not be effected.
Governing law and jurisdiction
These Terms and Conditions and any disputes arising out of or related to the M2CASH® website or Online Transaction Platform are governed by and interpreted by the laws of Australia, and each party hereto irrevocably submits to the exclusive jurisdiction of the courts of Australia. This is the case regardless of whether the Customer or User resides or transacts business with M2CASH® elsewhere in the world.
Without limiting the foregoing, the Customer/User acknowledges and understands that laws regarding foreign exchange contracts vary throughout the world, and it is the Customer’s/User’s obligation alone to ensure that they fully comply with any law, regulation or directive, relevant to the Customer’s/User’s country of residency with regards to the use of the Online Transaction Platform. For avoidance of doubt, the ability to access to the M2CASH® Online Transaction Platform does not necessarily mean that the services, and/or the Customer’s/User’s activities through it, are legal under the laws, regulations or directives relevant to the Customer’s/User’s country of residency.
All disputes or claims arising out of use of the M2CASH® website or Online Transaction Platform will be resolved in the state or federal courts located in NSW, Australia.
